This Privacy Policy is incorporated by reference into the Terms of Use (the “Terms”) for the PicPocket/Stories service and other services, applications and websites provided by us (the “Service”).  The terms “we” and “us” include PicPocket Labs, Inc. and each of our affiliates and subsidiaries.  The Privacy Policy explains how we:

  • collect,
  • use, and
  • disclose

information we obtain through the Service, but not through any other means.  Capitalized terms used in this Privacy Policy shall have the meaning set forth in this Privacy Policy or the Terms.

The “Service” means PicPocket and any websites or software applications offered by PicPocket Labs, Inc., but not any applications or websites offered by any third parties (“Third Party Publishers”) or their applications to which you have access through the Service.

This Privacy Policy may differ from the general privacy policy(ies) of Third Party Publisher’s other websites and applications, if any.

Personal Information” means information that alone or when in combination with other information may be used to readily identify, contact, or locate you, such as: name, address, email address, or phone number.  We do not consider Personal Information to include information that has been anonymized so that it does not allow a third party to easily identify a specific individual.

By using the Service, you authorize the Service to gather, parse, and retain data related to the provision of the Service and collect, use and disclose information as described in this Privacy Policy.

THE SERVICE COLLECTS YOUR INFORMATION

The Service collects Personal Information:

  • when you register;
  • during use;
  • when you communicate with the Service; and
  • from other users.

The Service also collects information, such as anonymous usage statistics, by using cookies, server logs, and other similar technology as you use the Service.

Personal Information Collection.  You must register to use the Service.  To register, you may need to provide Personal Information, such as your e-mail address, a user name, and password.  You may also provide other optional information.

Social Sign-On.  The Service collects Personal Information from social media websites when you use that social media website’s credentials to log in.  For example, when you log in with your Facebook credentials, PicPocket Labs, Inc. may collect the Personal Information you have made publicly available in Facebook, such as your name and profile picture.

Using the Service.  The Service collects information from you and about you from other users through the Service.  For example, when you interact with other users or make purchases, the Service collects provided information, including any Personal Information.

Making Payments.  When you make payments through the Service, you may need to provide Personal Information to our third-party service providers, such as your name, billing address, and credit card number.

Customer Support.  The Service may collect Personal Information through your communications with a PicPocket Labs, Inc. customer-support team member.

Location and Device Information from Your Mobile Device.  PicPocket Labs, Inc. may collect and store your location and device information.  Collection of this information may improve the provision of the Service and provide you with access to customized offers.

Cookies, Automatic Data Collection, and Related Technologies.  The Service collects and stores information that is generated automatically as you use it, including your preferences and anonymous usage statistics.

When you use the Service, we and our third-party service providers receive and record information on our server logs from your browser, including your IP address, and from cookies and similar technology.  Cookies are small text files placed in a user’s computer browser to store the user’s preferences.  Most browsers allow you to block and delete cookies.  However, if you do that, the Service may not work properly.  You can usually find out information about how to delete cookies on your browser through a “help” menu.

HOW WE USE YOUR INFORMATION

PicPocket Labs, Inc. uses Personal Information to:

  • facilitate and improve the Service;
  • provide marketing and advertising; and
  • communicate with you.

We may use information, including Personal Information and aggregate information, to operate the Service, to communicate with you, and for marketing and monetization purposes.

Internal and Service-Related Usage.  We use information, including Personal Information, for internal and service-related purposes and may provide it to third parties.  We may use and retain any data we collect to make and provide improvements.

Communications.  We may send email to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance.

Marketing.  We may use information, including Personal Information, to enable advertising and marketing, including to others both online and through other means.

Monetizing Information.  We collect and use information to make all of the functionalities of the Service possible.  We may sell aggregated, anonymized information to third parties or permit advertising to you by third parties based upon your Personal Information.

You may opt out of receiving certain marketing materials from PicPocket Labs, Inc., such as newsletters.  To do so, you will need to adjust the privacy settings for your account on the Service or decline to receive such marketing materials if and when provided the opportunity to opt out.

HOW TO REQUEST DELETION OF YOUR DATA

PicPocket Labs, Inc. will remove all Personal Data if a user requests account deletion through one of the following methods:

  • send an email to devteam <at> picpocket.com with the subject “Account delete request” and include the email address associated with the account
  • submit an account delete request via the mobile app (choose SETTINGS -> ACCOUNT -> DELETE ACCOUNT)

Upon receipt of an account delete request, we will remove all personally identifiable information within 3 business days and send an account deleted confirmation email to the email address associated with the requested account. Once an account has been deleted, it can not be recovered or reactivated.

WE MAY DISCLOSE YOUR INFORMATION

PicPocket Labs, Inc. may share your information:

  • with third-party service providers;
  • to comply with legal obligations;
  • to protect and defend our rights and property or the safety of other users; and
  • with your permission.

Remember that this Privacy Policy governs the use of any information collected about you on or through the Service even if a Privacy Policy of a Third Party Publisher for another website or application owned or operated by or on behalf of the Third Party Publisher has different policies for the collection and use of information about you.

We Use Vendors and Service Providers.  We may share any information we receive with vendors and service providers retained in connection with the provision of the Service.

Displaying to Other Users.  The content you post to the Service may be displayed on the Service.  Other users may be able to see some information about you, such as scores, achievements, comments and other content posted by you.  We are not responsible for privacy practices of the other users who will view and use the posted information you choose to make available on or through the Service.

Social Networking and Other Websites.  The Service allows you to share information, including Personal Information, with social networking websites, such as Facebook, Twitter and Google+.  The Service does not share your Personal Information with a social network site unless you direct the Service to share such information.  A third party site’s use of any information you disclose or authorize for sharing will be governed by the third party site’s privacy policies, and you may be able to modify your privacy settings on those third party sites.

Search Engines.  We may use Google Analytics to provide us with aggregated information about how users interact with the Website, and may set cookies and other web beacons for this purpose.  The information gathered by Google Analytics (including any Personal Information about you) will be sent to Google where it will be stored and used by Google in accordance with its own privacy policy rather than ours.  Please review the Google Privacy Policy or contact Google for more information.

Marketing.  We do not rent, sell, or share your Personal Information with other people or non-affiliated companies for their direct marketing purposes, unless we have your permission.  We may, however, allow access to other data collected by the Service to enable the delivery of online advertising on and through the Service, or otherwise facilitate transmittal of information that may be useful, relevant, valuable or otherwise of interest to you.  For example, we may target advertising towards you based upon your Personal Information without sharing your Personal Information with a third party.  If you respond to such advertising, then the third party may deduce that you meet certain characteristics (e.g., you are a woman between the ages of X and Y).  In all cases, both PicPocket Labs, Inc. may market its services to you directly and information collected through the Service.

As Required By Law and Similar Disclosures.  We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect yours’, ours’ or  others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers.  If PicPocket Labs, Inc. is involved in a change in control, merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of assets, or transition of the Service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.  We cannot control how such entities may use or disclose such information.

We may also disclose your Personal Information with your permission.

SECURITY OF YOUR INFORMATION

Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us.  We do not accept liability for unintentional disclosure.  Do not share any information on or through the Service if you are concerned about the unauthorized access to such information by a third party.

By using the Service or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service.  If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Service or sending an email to you.  You may have a legal right to receive this notice in writing.  To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please notify us at privacy@PicPocket.com.

CHILDREN’S PRIVACY

We do not knowingly collect information from children under 13 and we do not want it.  We will take steps to delete it if we learn we have collected it.

We do not knowingly collect, maintain, or use Personal Information from children under 13 years of age, and no part of the Service is directed to children under the age of 13.  If you learn that your child has provided us with Personal Information without your consent, you may alert us at privacy@PicPocket.com.  If we learn that we have collected any Personal Information from children under 13, we will promptly take steps to delete such information and terminate the child’s account.

INTERNATIONAL USERS

By using the Service, you will transfer data to the United States.

By choosing to visit the Service or otherwise provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of Texas and the dispute resolution provisions set forth in the Terms.

If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and processing globally.  By providing your information you consent to any transfer and processing in accordance with this Privacy Policy.

If you wish to withdraw your consent for the use and sharing of your Personal Information pursuant to this Privacy Policy, then you will need to terminate your account and cease all use of the Service.  You can deactivate your account by logging into your mobile account on the Service, clicking on “Profile,” clicking on “Edit Profile,” and clicking on “Deactivate Account.”

UPDATE YOUR INFORMATION OR POSE A QUESTION OR SUGGESTION

If you would like to update or correct any information that you have provided to us through your use of the Service or otherwise, you should log into your account on the Service, clicking on “Profile” and clicking on “Edit Profile” to update any outdated information. CHANGES TO OUR PRIVACY POLICY AND PRACTICES

We may revise this Privacy Policy, so please review it periodically.

Posting of Revised Privacy Policy.  We will post any adjustments to the Privacy Policy on this page of the Website, and the revised version will be effective when it is posted unless otherwise specified as set forth at the top of this Privacy Policy.  If you are concerned about how your information is used, bookmark this page and read this Privacy Policy periodically.  You are responsible for ensuring your continued acceptance of this Privacy Policy and your continued use of the Service following a change in the Privacy Policy will subject your use of the Service following any such change to the new provisions of this Privacy Policy.

New Uses of Personal Information.  From time to time, we may desire to use Personal Information for uses not previously disclosed in our Privacy Policy.  If our practices change regarding previously collected Personal Information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.
