Patent Counsel

John is a registered patent attorney whose practice includes the preparation of patent applications; domestic and foreign patent prosecution; portfolio development and management; the preparation of patent-related legal opinions, including freedom to operate opinions, non-infringement opinions, and invalidity opinions; patent-related transactional work, including the drafting and negotiation of confidentiality agreements, licensing agreements, and contracts; patent enforcement, patent litigation, and interference proceedings; and general client counseling in the field of intellectual property.

He has worked with clients in several different areas of technology relating to the fields of chemistry, semiconductor devices and semiconductor fabrication processes, optics, industrial processes, mechanical engineering, consumer products, e-commerce, and software and computer-related technologies.

Prior to founding FORTKORT & HOUSTON P.C., Mr. Fortkort worked as a partner at Mayer Fortkort & Williams PC, where he headed the firm’s office in Austin, Texas. Prior to that, he served as in-house patent counsel for the Minnesota Mining & Manufacturing Company (3M) for more than five years, where he worked both at 3M’s St. Paul, Minnesota and Austin, Texas locations. While at 3M, Mr. Fortkort served as patent counsel to 3M’s Specialty Chemicals Division, Specialty Films Division, Film/Light Management Technology Center, and Telecommunications Division, among others. The patent portfolios Mr. Fortkort helped to develop while at 3M support some of the company’s most profitable product offerings and businesses. Before that, Mr. Fortkort worked as an associate in Washington, D.C. at the law firms of Dickinson, Wright, Moon, Van Dusen & Freeman, and Finnegan Henderson, Farabow, Garrett & Dunner.
